00:02:19.720 | I want to begin this introductory episode with a discussion of what is asset protection planning.
00:02:25.700 | There are a couple of different components or a couple of different ways in which this term is used.
00:02:30.500 | Usually, when you see this term used in the financial planning literature, usually this is a legal strategy.
00:02:39.380 | The idea is what legal strategies can we put in place so that when we are in court, we can make sure to protect our assets from certain legal claims.
00:02:48.640 | And I think that's an appropriate use of the term.
00:02:51.140 | If you read 10 books on asset protection planning, the majority of those books, nine out of 10 of them, are going to be legal textbooks.
00:02:58.360 | And they're going to be talking about the use of a corporation for your business entities or the use of an LLC for your ownership activities or the use of a trust of some kind, be it an onshore trust or an offshore trust to hold your assets.
00:03:11.460 | That is an appropriate way for us to talk about asset protection planning.
00:03:16.060 | However, I think it's only part of the subject.
00:03:20.560 | And one of the themes that I have sought to emphasize in my public work here at Radical Personal Finance is that good financial advice crosses different people's circumstances.

00:03:33.680 | One of the concepts that I've sought to flesh out, which I'm not aware of other financial planners who emphasize this, maybe there are, but I've personally found it very helpful to always apply the lens of scale to all of my work.
00:03:46.660 | And to recognize that there are things that you do at one point in life, at one scale of financial wealth or one type of lifestyle that are appropriate.
00:03:56.120 | And those very same things may not be appropriate at a different scale.
00:03:59.840 | There are some forms of financial advice that are appropriate at one scale of wealth that are very inappropriate at another scale of financial wealth.
00:04:07.040 | There are some attributes of a certain investment product, for example, or a certain insurance product, for example, that are appropriate at one scale of wealth and income that are not appropriate at a different scale of wealth or income.
00:04:20.420 | And the same exact thing applies to asset protection planning.
00:04:24.260 | My hope is in the course of this series to demystify the term asset protection planning and provide you with ideas and strategies that are appropriate to you given your current scale, because everybody is engaged in some form of asset protection planning.
00:04:43.040 | If you lock your door at night or when you leave the house, or if you lock the door of your car, when you park it, you are engaging in asset protection planning.
00:04:56.260 | If you care for your health, you're engaging in asset protection planning.
00:05:01.860 | Now, I understand that that's a very expansive term, and in many ways, if I use such an expansive definition of asset protection planning, there is almost no topic that doesn't fit into this.
00:05:13.800 | For example, if I consider that your car is an asset, but I also consider that your physical health is an asset, then what else comes in?

00:05:23.600 | But is that not the truth?
00:05:26.320 | Would you trade out your physical health, but make sure that you could keep all of your money?
00:05:32.920 | I have for years defended the idea that your health is one of your most valuable assets because it's your health that leads you to the ability to enjoy life.
00:05:44.320 | It's your health that leads you to the ability to create income.
00:05:48.140 | If you have health, you can create income.
00:05:50.020 | If you can create income, you can always get financial assets over again.
00:05:54.360 | Most wealthy people, if given the choice between their health and their money, they'd quickly give up their money to get their health back if they could do so.
00:06:02.660 | Of course, it's not always possible.
00:06:05.060 | But I really believe that your health is an asset.
00:06:08.580 | I believe that your family is an asset.
00:06:11.700 | I believe that your marriage can be an asset.
00:06:14.900 | So why not bring those things in under the rubric of good financial planning?
00:06:21.860 | I can't sell a financial product to those things, which is why they're generally not discussed.
00:06:27.080 | An attorney who specializes in asset protection planning, that attorney has no professional knowledge or ability that makes them competent to advise you on your health.
00:06:36.960 | They can advise you on the creation of an offshore trust, or they can advise you on what form of corporation to use to set up your new business.
00:06:48.080 | And so, therefore, they emphasize that.
00:06:50.400 | They emphasize those.
00:06:52.260 | A financial advisor who sells insurance, that financial advisor is not competent to talk to you about the physical security plan for your automobile or for your house.
00:07:03.260 | That's not their area of expertise.
00:07:05.140 | They are competent to advise you on what type of insurance to buy to protect your liability or what type of life insurance to buy or what kind of disability income insurance to buy.
00:07:15.740 | And so because these are the specialties that are the loudest, then these are the things that people think of when they think of asset protection planning.
00:07:24.700 | And it's not a problem.
00:07:25.500 | There's nothing unethical or immoral about the financial advisor talking about life insurance or talking about using a qualified plan to invest through.
00:07:33.580 | There's no problem with the attorney focusing on the entity selection process.
00:07:38.980 | But there is a problem for you if you don't recognize that that's not the sum of your life.
00:07:48.420 | All of these other things are part of your life.
00:07:52.340 | And so as your friendly local podcast financial advisor, I consider it my job to try to talk to you about all of these things within my ability, or at least to inspire you to go and find another advisor who can advise you on these certain things.

00:08:31.460 | Now, in this introductory episode and throughout this series, I'm going to keep the episodes fairly short because this subject is one of those incredibly dense subjects where I could create, you know, 10 three hour episodes.

00:09:20.500 | You could use the rich dad, poor dad definition.

00:09:31.220 | Now, an obvious example of an asset could be money.
00:09:36.340 | Money that you have in your wallet, money that you have in a bank account, money that you have in an investment fund of some kind.

00:09:46.900 | But that asset of money could be diversified.
00:09:50.020 | For example, you might consider your business to be an asset because your business prints money for you.
00:09:55.380 | It creates money.
00:09:57.460 | Your career is an asset because that career allows you to create money.

00:10:07.700 | So now the idea of the term asset could be more inclusive.
00:10:11.060 | For example, your reputation could be an asset.
00:10:16.820 | If your reputation is slandered, that could seriously affect your earning ability.
00:10:23.780 | If your reputation is built on honesty and integrity and you lose that reputation, you may not have as many clients.

00:11:24.420 | All of these things being a mixture of real property and personal property, these are assets.

00:11:37.860 | There are other forms of assets as well.
00:11:39.380 | The intellectual property that you own.
00:11:42.420 | You might own rights to intellectual property that are extremely valuable.
00:11:47.460 | Or even just your own personal intelligence, your own personal mental ability.
00:11:53.700 | That can be a tremendous asset.
00:11:57.940 | Your life, your health, your spouse, your children.

00:12:08.980 | I consider my wife and children to be assets.
00:12:12.580 | They are extremely valuable and important to me.
00:12:15.220 | So when I think about asset protection planning, I don't think only about protecting money.

00:12:25.540 | Protecting my children's morality, their physical safety, their character.
00:12:31.300 | I think about how I can help grow that asset by investing into them, investing into their
00:12:38.180 | education, investing into their knowledge, investing into their life experience.
00:12:43.700 | And I expect that asset to pay off in the long run.
00:12:46.580 | I expect that asset to pay off and the pleasure of watching my children succeed in life.
00:12:52.500 | I expect that asset to pay off and the financial assuredness, the financial security of knowing
00:12:58.900 | that my children would care for me in my old age.
00:13:01.860 | This of course is a concept that very few parents think much about in the modern world,
00:13:08.420 | but I think it's an entirely valid one.

00:13:14.660 | You'll most commonly encounter this in the ethnic immigrants to the United States, where
00:13:19.380 | there's a much stronger family culture.
00:13:21.380 | And you'll usually find that parents will basically impoverish themselves for the education
00:13:27.780 | of their children, expecting that their children will provide for them in their old age.
00:13:33.700 | In my opinion, that's a right and upright thing to do.
00:13:36.340 | It's nice if the parents don't need that support, but isn't that a nice safety net
00:13:40.980 | to build?
00:13:42.980 | Now look at the interplay of an unusual topic like that between financial planning and asset
00:13:50.100 | protection planning.
00:13:52.420 | If you're going to invest your time into your children, as you raise your children,
00:13:58.180 | you might pull back from your career and invest in their life, invest in their persons.
00:14:04.500 | You might invest in their education with your time and with your money, opening up the door
00:14:08.820 | to many opportunities for them.
00:14:11.060 | You might spend tens of thousands or hundreds of thousands of dollars on their education.
00:14:17.580 | You might lend them money to establish them in a new business, give them property to help
00:14:22.700 | them be established in a new life.
00:14:26.940 | How do you protect that investment?
00:14:29.580 | Well, your asset protection planning should include a consideration of that.
00:14:36.380 | This would range from protecting them from physical danger of a predator of some kind
00:14:40.900 | that might seek to harm them.
00:14:42.940 | But it also includes things like purchasing a life insurance policy on their life so that
00:14:47.540 | if they die prematurely, you can recoup some of your investment money, which helps to protect
00:14:53.340 | you from what is a great personal loss and a great financial loss.
00:15:03.100 | You'll have to think about what the assets are that are important to you.
00:15:10.580 | But if you think about the term asset expansively, you will probably make wise decisions about
00:15:18.820 | how to protect them.
00:15:21.120 | This stuff is intuitive.
00:15:24.220 | The problem with many teachers of asset protection planning is they go so quickly towards the
00:15:30.060 | esoteric areas of finance and legal theory that require specialized knowledge.
00:15:38.020 | They miss some of the low hanging fruit.
00:15:40.260 | That's why I'm laboring on this topic of physical safety.
00:15:45.140 | Your asset protection planning, you can justify when you're shopping for a car, you might
00:15:52.340 | carefully consider that that one car will more effectively protect the asset of your
00:15:57.540 | life and your physical health and your children from the risk of a crash.
00:16:03.540 | And so you might make one car buying decision versus another because this car is safer than
00:16:07.380 | that.
00:16:08.380 | That's asset protection planning for mortals, not for lawyers, for mortals.
00:16:15.140 | And you should consider that.
00:16:17.260 | So think about what is an asset.
00:16:19.580 | What is the asset that you're trying to protect?
00:16:22.740 | So that's question number one.
00:16:24.300 | What asset are you concerned with?
00:16:26.500 | Question number two, from whom are we protecting the asset?
00:16:30.540 | Or stated differently, from what risk are we protecting the asset?
00:16:35.100 | Who is your potential adversary?
00:16:38.260 | Your adversary will differ in different circumstances and not all planning techniques will help
00:16:45.500 | you from all adversaries.
00:16:46.780 | It's simply impossible.
00:16:50.420 | It's very possible that you could buy a safe car and that would help you to protect the
00:16:55.580 | asset of your life, your physical health, your spouse and your children's lives and
00:16:59.500 | their physical health from the risk of physical injury or death due to a car accident.
00:17:08.420 | But that choice will make no difference whatsoever in protecting that car if you get behind on
00:17:16.700 | your payments.
00:17:19.620 | If you get behind on your payments, the lender who actually owns the car, who has a lien
00:17:24.700 | on the car, that lender will come and repossess the car and now you'll be without a car.
00:17:30.300 | So you need to think about this expansively.
00:17:33.500 | And there's always a balancing act, a trade-off here.
00:17:38.100 | Forgive me if this example gets too convoluted over something so simple.
00:17:41.840 | This is what you think of already, but I want to give names to it.
00:17:46.260 | So let's expand this example.
00:17:48.660 | You recognize the asset you're trying to protect is your physical life, the life and health
00:17:54.820 | of your family and your ability to create an income because for you to create an income,
00:17:59.140 | you have to be able to get to work.
00:18:01.020 | So you're protecting your asset of income by purchasing a car.
00:18:05.380 | But you recognize, and so because you're protecting these things, you recognize you need a car,
00:18:10.340 | you need a reliable car and you need that reliable car to be somewhat safe.
00:18:15.820 | But you also recognize that if you go and you buy a brand new car to get the very latest
00:18:20.460 | and greatest, you have a risk of falling behind on that payment and not being able to afford
00:18:24.940 | it and thus you could lose the car.
00:18:28.800 | So you know that you need a car that's safe, that's reliable, but it also needs to be financially
00:18:34.300 | modest in cost.
00:18:37.100 | And so when purchasing the car, you think carefully about that and you shop carefully
00:18:40.960 | for a good quality car that's a much more modest price that you can actually afford.
00:18:47.380 | Now when purchasing that car, as I expand on the example of even how you finance it,
00:18:52.460 | in my recent course on credit cards that I delivered, one of the examples that I gave
00:18:56.740 | of how credit cards can allow you to borrow money more safely is credit cards are an unsecured
00:19:01.460 | loan.
00:19:03.060 | And so they provide some additional safety for you to be able to own a car if you can
00:19:06.860 | buy it using credit cards versus a car loan.
00:19:10.220 | Because now the creditor, if you have to borrow money for the car, the creditor doesn't have
00:19:15.020 | that direct ability to repossess.
00:19:17.180 | Credit card company can't automatically repossess the car.
00:19:20.500 | So now instead of financing the car with a personal loan at your local credit loan on
00:19:26.740 | a car loan, you finance the car with a cash advance on a credit card.
00:19:30.800 | Other dangers there, but it protects the asset of that car.
00:19:34.500 | And then in looking at it, you make sure that your ownership of that vehicle protects the
00:19:40.940 | asset.
00:19:41.940 | So instead of owning that vehicle in your personal name, you register that vehicle into
00:19:46.500 | an entity, an LLC, a trust, some kind of entity to hold title to that property.
00:19:53.380 | So it's not even clearly visible to somebody who's doing an asset search on you what vehicle
00:19:58.260 | you own.
00:20:00.380 | It's not automatically registered to your driver's license so that when a private investigator
00:20:04.000 | goes down and pulls your driver's license and figure tries to figure out what vehicles
00:20:07.020 | you own, they can't automatically find that.
00:20:09.260 | They have to come and perform some form of physical surveillance on you and your property
00:20:13.420 | to discover what car you own.
00:20:17.460 | And then you make sure that you properly insure that car by insuring the car, if it gets damaged
00:20:23.740 | or if it gets stolen or if it's in the shop.
00:20:27.180 | And then you put in place other savings so that you can afford to rent a car when the
00:20:31.100 | car breaks down, et cetera.
00:20:33.380 | Now what I've done is just in that example, taken something fairly simple that we all
00:20:37.340 | do all the time, buying and selling cars, and I've made it sound very complicated to
00:20:42.460 | point out the components of asset protection planning.
00:20:47.100 | But if you think about it, it'll allow you to make certain decisions step by step by
00:20:51.220 | step that will protect you.
00:20:54.300 | Now everything I've given to you in that example is part of asset protection planning.
00:21:00.380 | By choosing a quality, modern, safe car, you're protecting your savings from excessive mechanics
00:21:09.100 | costs, excessive repair costs.
00:21:12.460 | By choosing a car with a good crash rating and excellent safety features, you're protecting
00:21:17.260 | your life.
00:21:19.180 | If you get in a car accident, which is a high probability throughout our lifetime, you're
00:21:22.820 | protecting your life so that you can still keep working and not be injured in a car accident.
00:21:28.860 | You're protecting your family so that they can keep from being injured, hopefully, or
00:21:33.380 | keep from being killed.
00:21:36.340 | Think about the financial devastation that can occur if you're in a serious car accident.
00:21:42.140 | One of your children is killed.
00:21:44.660 | Your spouse is injured.
00:21:46.820 | You're unable to work for a period of time.
00:21:48.860 | Think about the devastation that wreaks in your life.
00:21:56.460 | Now by owning that vehicle privately, registering it in a protective entity of some kind, personal
00:22:05.620 | property trust, LLC, then you're protecting yourself and that car against the knowledge
00:22:13.700 | of other people of your assets, which helps to protect you in civil litigation.
00:22:18.300 | By not having financing on that car, you're protecting it from a creditor.
00:22:23.280 | By having a good insurance policy that protects your personal damage to the car and also your
00:22:27.620 | liability in the use of that car, you're protecting your other assets from any kind of negligence
00:22:34.140 | that may happen or any kind of liability that may be incurred through your driving.
00:22:42.020 | And you're dramatically minimizing the impact on your life that can come from something
00:22:49.220 | as simple as a car.
00:22:52.780 | Now let's compare that with the behavior and the actions of people who are clueless.
00:22:59.740 | People who are clueless buy junky cars that look junky.
00:23:04.460 | This brings them to the scrutiny of the local police.
00:23:08.020 | They drive with headlights out or license plate bulbs out, which gives the local police
00:23:12.180 | probable cause to stop them.
00:23:14.900 | Then the local police search the car, find problems, lock them up, and then they spend
00:23:18.340 | their life on the legal plantation.
00:23:21.840 | People who are clueless buy new cars, which might help them to avoid the notice of the
00:23:25.940 | police, but unfortunately, they wind up spending too much money, which allows them to not have
00:23:31.260 | any savings to protect.
00:23:33.580 | And that might protect them physically, but then what do they do when they get in an accident
00:23:39.380 | and the insurance company just barely covers the cost of the car, but now they have nothing
00:23:42.960 | else to drive?
00:23:45.740 | And I could expand this on, but I've gone too long on this example already.
00:23:49.180 | Just consider the decisions that people make and then watch how these decisions accumulate
00:23:52.840 | in people's lives.
00:23:54.700 | Prudent, careful people avoid many of the catastrophes that foolish, stupid, clueless,
00:24:02.700 | careless people are constantly engaged in.
00:24:06.180 | It's not an accident.
00:24:08.660 | There are things that are outside of all of our control, but that's the minority, not
00:24:14.900 | the majority.
00:24:16.260 | So in asset protection, think about the asset that you're protecting and then from whom
00:24:19.740 | or what risk are we protecting the asset?
00:24:21.740 | Who is your adversary?
00:24:23.340 | Here, your adversary and your plan will vary depending on your adversary.
00:24:29.380 | Let's start with something like a simple thief.
00:24:31.500 | If you're concerned about protecting your assets from a simple thief, somebody who's
00:24:36.100 | going to steal your assets, your plan will vary.
00:24:40.780 | If you're concerned about protecting your cash from your roommate or from a friend,
00:24:46.140 | then you'll hide the cash.
00:24:48.740 | You'll secure the cash using a lock strong box of some kind.
00:24:53.580 | You'll also protect yourself from identity theft by making sure you don't leave out important
00:24:57.580 | papers.
00:24:58.580 | Majority of identity theft, in my understanding, is committed by people who know the person.
00:25:03.140 | So you don't leave unlocked drawers that have your personal private papers in them.
00:25:07.280 | You make sure to secure those things.
00:25:09.580 | That's different than if you're considering an adversary being a creditor, somebody who
00:25:14.040 | has lent you money.
00:25:16.740 | Protecting yourself from the claims of a creditor will involve certain steps of asset protection
00:25:22.700 | planning.
00:25:23.700 | But that's also different than a civil litigant.
00:25:26.100 | You might have no debts today, but then you might be sued tomorrow and all of a sudden
00:25:34.980 | wind up in a losing position in a lawsuit owing now a creditor money because they've
00:25:41.420 | obtained a legal judgment against you.
00:25:43.440 | Not because you set out to borrow money on a car or a house or in a business deal, but
00:25:48.300 | simply because they were able to win their case against you.
00:25:52.360 | And so your asset protection should involve planning against a civil litigant.
00:25:57.540 | Now a creditor or somebody who gets a judgment against you, that's very different than protecting
00:26:02.060 | yourself against the IRS.
00:26:05.260 | You can protect your assets against the IRS, but it involves different plans than a simple
00:26:10.960 | creditor.
00:26:11.960 | Or what about the police?
00:26:15.360 | Protecting yourself and your assets against the police is extremely important.
00:26:19.380 | One of the huge personal concerns that I have is what in my opinion is the abuse of civil
00:26:25.900 | asset forfeiture laws in the United States of America.
00:26:30.540 | I hate it.
00:26:32.140 | So you need to understand what your rights are and how to protect yourself from the police.
00:26:36.100 | Let me give you a simple, absolutely legally true example as to how this is so important.
00:26:41.580 | Let's say that you are accustomed to dealing in cash and because you like to get good deals
00:26:47.420 | on your vehicles, you're on your way to go and buy a $10,000 or $15,000 minivan and you've
00:26:54.300 | got a stack of $100 bills in your pocket.
00:26:58.420 | Now in the United States, if you have in excess of $5,000 of cash, law enforcement can seize
00:27:03.660 | that cash if they become aware of it.
00:27:06.340 | So you're driving down the road on your way to go and buy your new vehicle and you've
00:27:09.420 | got $10,000 in your pocket.
00:27:11.160 | Not that big of a deal, really not.
