we're gonna talk about Johnny Depp and Amber Heard. 00:01:06.000 |
a show dedicated to providing you with the knowledge, 00:01:17.000 |
and I'm not usually drawing from the tabloids 00:01:21.000 |
with regard to choosing topics for Radical Personal Finance, 00:01:25.000 |
but this one is important in many different areas. 00:01:38.000 |
digging into the Johnny Depp thing, Amber Heard thing. 00:01:44.000 |
I'm interested in it from a legal perspective, 00:02:01.000 |
So we're gonna talk about some difficult subjects today, 00:02:10.000 |
then definitely this is a show that they need to listen to. 00:02:14.000 |
this is probably a better one for them to skip. 00:02:19.000 |
by BitcoinPrivacyCourse.com, BitcoinPrivacyCourse.com. 00:02:29.000 |
There's actually a whole big recent development now 00:02:38.000 |
and how much is the Bitcoin worth, and all of that. 00:02:43.000 |
because I'm not encouraging you to hide your money in Bitcoin. 00:02:51.000 |
I guess I'll leave it up to you and your good judgment. 00:02:53.000 |
If you're interested in learning how to buy Bitcoin privately, 00:03:01.000 |
a course that I developed with my friend Gabriel Custodiat 00:03:03.000 |
from Watchman Privacy called BitcoinPrivacyCourse.com. 00:03:14.000 |
go to BitcoinPrivacyCourse.com and check it out. 00:03:30.000 |
It can be one of the biggest things that causes us trouble. 00:03:38.000 |
and you wind up in a $50 million defamation lawsuit. 00:03:41.000 |
That's probably not the situation that you're in, 00:03:49.000 |
I think what's more common would be arguments in divorce, 00:03:57.000 |
when one partner starts abusing the other partner. 00:04:11.000 |
And I think most, at least all the listeners, 00:04:36.000 |
We probably don't have as high of a confidence 00:04:42.000 |
I've known a lot of people that in years past, 00:04:59.000 |
I know I myself felt that way when I was younger. 00:05:07.000 |
I think that's been a change in that, I've noticed, 00:05:18.000 |
but the process itself was not just, et cetera. 00:05:31.000 |
protecting yourself so you can do what's morally right 00:05:33.000 |
while you're dealing with a questionable legal system. 00:05:46.000 |
that I'm drawing on for a portion of today's show. 00:05:49.000 |
I've talked about why you shouldn't talk to the police 00:05:54.000 |
Alec Baldwin, his statement that he made to the police 00:06:04.000 |
Just be silent and lawyer, that's all you say. 00:06:09.000 |
in which not talking to the police is not enough. 00:06:16.000 |
specifically the two topics are having sex with minors 00:06:31.000 |
And they're areas where you might wind up in legal trouble 00:06:36.000 |
or even face allegations where your career can be crumbled, 00:06:42.000 |
And so you have to be very, very proactive in this space 00:06:53.000 |
One of my favorite lines from the King James Bible, 00:07:08.000 |
I wanna begin with reading to you a few excerpts 00:07:22.000 |
has been something I've recommended so many times. 00:07:29.000 |
"When Girls Tell a Tale That Sends You to Jail." 00:07:43.000 |
It's something that I think has been given short shrift 00:07:55.000 |
But I'm just gonna go ahead and take the chapter as it goes. 00:08:04.000 |
"it discusses sex and crime from a man's point of view. 00:08:07.000 |
"It advises men how to defend themselves against women, 00:08:10.000 |
"but it does so by urging them to be aware of 00:08:26.000 |
"yet the cops and courts now arrest and prosecute men 00:08:31.000 |
"were either ignored or considered non-criminal." 00:08:39.000 |
"women have not been able to get themselves arrested 00:08:41.000 |
"as often as men, who are just better at it." 00:08:53.000 |
because either of these offenses can get you hammered 00:09:04.000 |
One of the things that this particular book does extremely well 00:09:24.000 |
And you get involved in it by getting yourself arrested. 00:09:26.000 |
And the whole point of this book is not getting arrested. 00:09:29.000 |
I will link in the show notes to the full episode 00:09:35.000 |
It is--I don't know if it's still the most popular, 00:09:38.000 |
but for many years it was the most popular episode 00:09:42.000 |
You need to hear that episode in order to understand all the details, 00:09:46.000 |
but that's what the "electronic plantation" refers to. 00:09:52.000 |
that it's not enough to say, "I'm innocent of a crime 00:09:55.000 |
and I'll go in front of a jury and be found innocent." 00:09:58.000 |
It convinced me that I don't want to have anything to do with the system. 00:10:04.000 |
And so I'm going to be very careful to avoid anything 00:10:06.000 |
that could ever bring me to the point of getting arrested. 00:10:14.000 |
with your very own photo on bulletin boards of sexual predators 00:10:17.000 |
so that your neighbors will hate and fear you forever. 00:10:21.000 |
The states have their reasons for aggressively arresting men. 00:10:24.000 |
They have had it with the social chaos caused by unwed mothers. 00:10:28.000 |
Thus, they enforce statutory rape, which is sex with minor girls, 00:10:34.000 |
As to strict enforcement of laws against domestic disturbance 00:10:37.000 |
and domestic battery, prosecutors point out that murders of women 00:10:42.000 |
drop by half when these laws are strictly enforced. 00:10:47.000 |
Most men have no idea how seriously offenses against women 00:10:56.000 |
These laws are often enforced by female police officers, 00:11:03.000 |
Some of these women are on a mission from God to make men miserable. 00:11:10.000 |
These laws are vigorously enforced, and you have to deal with them. 00:11:16.000 |
Getting savvy and arrest-proofing yourself is the only defense. 00:11:23.000 |
You may be okay with bopping underage ladies, 00:11:32.000 |
The age of consent, which in standard English means the age at which 00:11:35.000 |
a girl can have consensual sex with you without your being at risk 00:11:38.000 |
of going to jail, varies from state to state. 00:11:45.000 |
so if you're a year or so older than the girl, you may not be in violation. 00:11:49.000 |
Generally, however, if you're 20 or older and your girl is 17 or younger, 00:12:02.000 |
"The sex is not only mind-blowing but consensual." 00:12:07.000 |
"Those little hearts she draws above the letter I are as cute as lace pants." 00:12:13.000 |
Underage girls cannot legally consent to have sex, 00:12:17.000 |
just as they cannot legally enter into binding contracts 00:12:22.000 |
Weirdly, many states allow a single exception to the inability of minor girls 00:12:32.000 |
but she cannot consent for you to make her baby. 00:12:36.000 |
Your young darling, no doubt glowing with love and exuding health and pheromones, 00:12:40.000 |
generally wants to talk to other women about the rapturous sex she's enjoying. 00:12:45.000 |
Women have to share experiences for them to be fully real. 00:12:48.000 |
Alas, these feminine interlocutors generally are the girl's mother or best friend, 00:12:54.000 |
and these guardians cannot wait to dial 911 and rat you out to the cops. 00:13:00.000 |
Sex with a minor is a strict liability offense. 00:13:05.000 |
In standard English, this means there ain't no defense except one. 00:13:13.000 |
The fact that the sex was consensual means nothing in court. 00:13:22.000 |
If a girl lies, shows a fake ID, or deceives you into having sex, 00:13:30.000 |
Likewise, any imputations about her character are inadmissible too. 00:13:35.000 |
Your only hope of dismissal or acquittal is if the girl lies or refuses to testify. 00:13:44.000 |
Statutes define sex with a young girl as "sordid." 00:13:53.000 |
Soft caresses and butterfly kisses are called "lewd and lascivious conduct." 00:14:08.000 |
I'm going to tell you about an old cop trick that gets you to unknowingly confess to statutory rape 00:14:12.000 |
and dump yourself in the can before you even realize it. 00:14:16.000 |
Once it is established that the girl you allegedly had sex with was underage, 00:14:21.000 |
the cop will always ask in a calm, man-to-man tone, 00:14:28.000 |
If you blurt out, "Yeah, man, she dug it," or something to that effect, 00:14:39.000 |
The only defense allowable in court in most states is that sex never happened, period. 00:14:46.000 |
So when you're being interrogated about sex with an underage girl, 00:14:50.000 |
give police your legal name and address, then clam up. 00:14:55.000 |
Put a sock in it, shut the heck up, speed dial your attorney, 00:14:58.000 |
your butt's in hot water, and the popo will be turning up the heat. 00:15:05.000 |
I usually find it distasteful to talk about a lot of this stuff, 00:15:08.000 |
and I'm at an age where it doesn't really--I'm married, I'm getting old now, 00:15:16.000 |
But I have a lot of listeners of the podcast who are younger 00:15:20.000 |
and who are in different stages of life, and this information is extremely important. 00:15:24.000 |
You need to emphasize what he said, is that sex with minors is statutory rape, 00:15:36.000 |
So how do you make sure that you don't do it? 00:15:44.000 |
You must do two things to arrest-proof yourself. 00:15:46.000 |
First, find out the age of consent in your state. 00:15:50.000 |
Make sure you get information on the young love exception if you're near the girl in age. 00:15:56.000 |
Second, and most important, check that your girl is of age in the following manner. 00:16:10.000 |
Imagine you're in the bedroom, the candles are burning, and the cover is drawn. 00:16:13.000 |
The girl is opening her arms and whispering, "Love me," 00:16:16.000 |
in musical tones that reverberate to the dawn of time. 00:16:19.000 |
There's hardly any thinking going on, so timing is crucial. 00:16:23.000 |
You've got to get the ID before the coital avalanche, and the earlier, the better. 00:16:29.000 |
Often the girl will protest, "Don't you trust me?" 00:16:32.000 |
The answer, of course, is, "Of course I do, but..." 00:16:37.000 |
In sex, as in nuclear arms control, the watchwords are "trust" but "verify." 00:16:43.000 |
Since it's nearly impossible to think when your blood is boiling with lust-- 00:16:49.000 |
here are some magic words to say to winkle out the all-important ID. 00:16:56.000 |
"Darling, our love is strong, and we've got to be strong. 00:16:59.000 |
"Showing me your license is the strongest proof that you love me 00:17:02.000 |
"and that what we're doing is right, so very, very right. 00:17:07.000 |
"Our love will only get better, sweeter, and closer over time." 00:17:10.000 |
After you say these words, if no license is forthcoming or if she's too young, 00:17:15.000 |
whisper a sweet goodbye and then run like hell. 00:17:19.000 |
Don't go back. No calls, no letters, do nothing. 00:17:23.000 |
Do you know what cops call love letters and messages left on answering machines 00:17:30.000 |
Obviously, you should know who you're having sex with. 00:17:35.000 |
I'll skip a couple of the next things, but the point here is simply this. 00:17:45.000 |
The best way to avoid being convicted of or accused of any kind of sexual crime 00:17:52.000 |
or sexual misconduct is to not commit any sexual misconduct or any sexual crime. 00:18:01.000 |
What I believe is the best way to do it is to wait until you are old enough to marry, 00:18:07.000 |
find a woman, court her, marry her, and then have sex with her. 00:18:15.000 |
It's been wonderful. It doesn't solve all the problems. 00:18:17.000 |
Lots of guys that later go on to deal with the next section of domestic abuse, 00:18:22.000 |
et cetera, domestic disturbance, sometimes it ends in divorce and it gets awful. 00:18:27.000 |
It doesn't solve all the problems, but it solves a significant number of these problems. 00:18:33.000 |
If you're not going to practice that, then you need to make sure that you avoid 00:18:47.000 |
In addition, as Dunham stated, even if you don't have sex with an underage girl, 00:18:55.000 |
make sure that there's never any hint of your being in a relationship with an underage girl 00:19:04.000 |
Even if there's no legal argument against you, that in and of itself can destroy your life, 00:19:12.000 |
especially in an era in which that evidence that you have committed, 00:19:18.000 |
that you have given to somebody, is easily publicized. 00:19:24.000 |
In the modern age, one of the most powerful tools that we all have to blackmail another person, 00:19:30.000 |
to take down another person, is to publish the evidence that we have of that person's misconduct. 00:19:36.000 |
And if there's ever even a hint of misconduct or a situation that could be construed as being misconduct, 00:19:42.000 |
even if you did the right thing, the evidence that you left behind may wind up sinking you. 00:19:50.000 |
I always use the example of Joseph from the Bible with my children to teach them this. 00:19:56.000 |
If you remember the example of Joseph, Joseph was sold by his brothers into slavery. 00:20:02.000 |
He was taken to Egypt. He was bought as a slave by a man named Potiphar. 00:20:06.000 |
Potiphar found that Joseph was a very good slave, and Potiphar gave Joseph a significant amount of responsibility 00:20:13.000 |
to serve as the steward of his house. Joseph was a very good-looking young man. 00:20:20.000 |
Joseph was beautiful. He was strong. He was muscular. He was very attractive. 00:20:25.000 |
And Potiphar's wife found herself sexually attracted to Joseph. 00:20:30.000 |
Potiphar went out of town on business, and Potiphar's wife, whenever Potiphar was gone, 00:20:36.000 |
was frequently trying to get Joseph to come and sleep with her. 00:20:39.000 |
So she enticed him again and again. He refused every time. 00:20:43.000 |
So then Potiphar's out of town. She gets Joseph to come by, and she says, "Joseph, come and sleep with me." 00:20:49.000 |
And he says, "No." She gets angry at him, and he turns and he runs away. 00:20:54.000 |
Doesn't have sex with her, doesn't assault her in any way. 00:20:57.000 |
But in running away, she's able to get his cloak, his robe. 00:21:01.000 |
So he runs away naked, because she pulled off his robe, and she's got his robe. 00:21:06.000 |
Well, now she screams, calls the other servants, and she has firsthand proof of Joseph's alleged attempt to rape her, to assault her. 00:21:15.000 |
And she's got the proof of it, because of his robe. 00:21:19.000 |
Joseph did everything right, as far as we know. 00:21:22.000 |
In fact, interestingly, he's one of the very few characters in the Bible of whom no immoral behavior is ever recorded. 00:21:30.000 |
It's very hard to find anyone in the Bible who you don't see all the bad stuff. 00:21:34.000 |
Joseph is one of the very few characters who's--there's really nothing bad that you can ever say about him. 00:21:41.000 |
And so Joseph winds up getting sent to prison. He's in prison for decades, a very long time, because of his upright behavior. 00:21:50.000 |
Probably would have been safer if he just had sex with her. 00:21:55.000 |
So this is the classic example, meaning he would have been morally wrong to sleep with another man's wife, and he would have had that on his conscience. 00:22:02.000 |
He wouldn't have been in prison, most likely, but he wouldn't have been wrong. 00:22:07.000 |
And so what was the key thing in that situation? 00:22:10.000 |
Well, part of it, you may argue that Joseph should have gotten away sooner, but that's really hard to argue. 00:22:17.000 |
If you can imagine, if you're in a job and your boss is coming on to you in some way, that's a really awkward situation to be in, especially when it first happens. 00:22:30.000 |
Because you're sitting there saying, "I want to keep my job. I don't want to do anything that's wrong, but I also don't want to be rude." 00:22:37.000 |
Because you know that this person has control over you. 00:22:40.000 |
If you rebuff your boss's advances, then now all of a sudden your boss has the ability to make your life miserable. 00:22:47.000 |
And so, of course, what a lot of people naturally do, totally understandable, is try to balance it, right? 00:22:54.000 |
Try to not rebuff your boss and tell him he's a pig and harm your career, but also try to not go all the way to giving in to him in some way. 00:23:14.000 |
The only way to win is to not be there in the first place. 00:23:17.000 |
But then you're in a situation where you were in it somewhat how, and now there's physical evidence. 00:23:22.000 |
And it's my story against your story, but who has more evidence? 00:23:26.000 |
In that situation of Joseph and Potiphar's wife, Potiphar's wife had Joseph's clothes. 00:23:39.000 |
Nothing has changed in, what, 6,000 years, 5,000 years, 4,000 years? 00:24:01.000 |
And in this situation, right, you see clearly women and men. 00:24:12.000 |
Number one, keep your behavior upright and moral. 00:24:17.000 |
Number two, if you ever find out that you're involved in some kind of illicit relationship, 00:24:23.000 |
either because it's an underage girl or because it is, you know, you're married or she's married, 00:24:31.000 |
something like that, get out and cut off the evidence. 00:24:39.000 |
Everything that you send, and we'll talk more about this in a moment, but we'll talk about it now. 00:24:44.000 |
As you see right now in the Johnny Depp Amber Heard trial, one of the things that is a feature of our modern world 00:24:50.000 |
is you have to assume that every single word that you say is being recorded anytime you ever say it 00:24:57.000 |
and that it'll be published to the entire world. 00:25:01.000 |
Because for the first time in human history, any person can record any other person 00:25:13.000 |
Go back to the 1990s, and if you wanted to find a surreptitious recording device, 00:25:21.000 |
you had to come up with some kind of surreptitious recording device. 00:25:23.000 |
Today, every single phone is a recording and broadcasting device. 00:25:29.000 |
Today, every single old phone is a recording and broadcasting device that can broadcast. 00:25:35.000 |
You can take your old phone, pop a SIM in it, stick it in someone's car. 00:25:41.000 |
Now you have a recording of everything that happens in that car. 00:25:45.000 |
It's just, right, this is the spy novels of the '90s and the 2000s. 00:25:50.000 |
Now that equipment is available to all of us. 00:25:54.000 |
The CIA in the 1960s would have dearly loved to have something as small as a cell phone 00:25:59.000 |
that you could put a--start a phone call in, you can stick it in someone's car with the volume off, 00:26:05.000 |
and record everything that that person says in their car. 00:26:13.000 |
Every single Apple Watch or smartwatch of any kind is a recording device. 00:26:20.000 |
I've got multiple microphones, little itty-bitty microphones that are wireless transmitters 00:26:24.000 |
that I can put anywhere, and they'll translate--transmit hundreds of yards to a receiver 00:26:28.000 |
that I can then record everything, and they last for hours. 00:26:31.000 |
Even if there's no receiver, they record, right? 00:26:33.000 |
I've got these little microphones that I use. 00:26:37.000 |
And they don't give anything off, just a tiny little thing, stick it under a chair, etc. 00:26:41.000 |
So in the modern world, you have to assume that every word that you say is going to be recorded. 00:26:50.000 |
Now I don't think that's necessarily a bad thing. 00:26:56.000 |
It has psychological impact when you feel you're on display all the time. 00:26:59.000 |
You don't really feel comfortable oftentimes kind of being yourself, etc. 00:27:05.000 |
But on the other hand, it's probably not a bad thing, meaning that we should--we're ultimately, 00:27:09.000 |
in eternity, when we stand before God, we're accountable for every word that we've said, 00:27:12.000 |
every action that we've done, so why not go ahead and recognize that and start living that way? 00:27:16.000 |
Don't say things that you're going to regret. 00:27:18.000 |
Don't do things that you're going to regret, and avoid times of weakness that are going to keep you 00:27:25.000 |
Don't be intoxicated in some other way that's going to cause you to do something that's wrong. 00:27:30.000 |
Don't be--be proactive to try to avoid situations when you're weak. 00:27:40.000 |
The point is that in today's world, those mistakes can be transmitted to a global audience in an instant. 00:27:49.000 |
And the person who has any kind of evidence in a "your word against my word" affair will quickly find 00:27:56.000 |
that evidence is usually heard more strongly. 00:28:13.000 |
In the old days, yes, you could send a letter, and that letter is evidence. 00:28:16.000 |
But today, you could send a letter, that letter gets taken a picture of, it gets published, 00:28:20.000 |
it goes around the world, you don't have a chance to tell your side of the story. 00:28:24.000 |
Think of what Johnny Depp is going through, right? 00:28:26.000 |
He had his side of the story, and the only way it seems that he could get his side of the story out 00:28:31.000 |
was to shut his mouth, be pilloried for a long time by a lot of people, 00:28:37.000 |
to be assumed to be the worst guy in the world until he could get to court. 00:28:41.000 |
And there in a controlled environment, getting to court, he could do that. 00:28:45.000 |
Well, you probably don't have Johnny Depp's resources. 00:28:51.000 |
And that information, once it gets out there, is massively powerful. 00:29:01.000 |
But think about people who 40 years ago, 50 years ago, 60 years ago, 00:29:06.000 |
were alleged to be involved with something, right? 00:29:09.000 |
You think of the--I don't need to name any names, right? 00:29:14.000 |
But that one letter was there, the yearbook, that was the evidence. 00:29:18.000 |
Well, today, that evidence, it's public and it's permanent forever. 00:29:42.000 |
And more importantly, if you ever have any indication that you're in any kind of relationship with a minor, stop. 00:29:52.000 |
I've known more than one young man, right, 20 years old, had a relationship with a teenager, marks him for life. 00:30:13.000 |
In centuries past, male "correction" of female behavior was administered with the back of the hand and accompanied by appropriate roars and bellows. 00:30:22.000 |
In the 21st century, behavioral correction of the female has different names. 00:30:30.000 |
The back of the hand is known as domestic battery. 00:30:33.000 |
Both will get you arrested and jailed in a hurry. 00:30:38.000 |
Tough enforcement has good and bad consequences. 00:30:41.000 |
On the one hand, many women and men avoid serious injury. 00:30:45.000 |
On the other, states now intervene early in disputes. 00:30:49.000 |
Arguments that once might have been resolved by participants now result in arrests and imprisonment. 00:30:56.000 |
Participants are consigned to the social services plantation. 00:31:00.000 |
Children are removed from parents and dumped into hellish foster homes. 00:31:05.000 |
Men are sentenced to anger management classes and all and sundry are psychoanalyzed, cataloged, and managed by government employees. 00:31:15.000 |
The arrests and all too often the voluminous social services and medical records get into the electronic plantation, 00:31:22.000 |
where they are accessed by prospective employers, ex-spouses, and civil litigants. 00:31:27.000 |
A few yelling matches can rapidly become a criminal, social, psychological, and financial furball. 00:31:39.000 |
It may be a natural occurrence, but it can also be a crime. 00:31:45.000 |
Domestic dispute laws are enforced most strongly against the poor and the clueless for a simple reason. 00:31:54.000 |
In apartments, sounds carry through walls, and neighbors call the cops. 00:31:59.000 |
In freestanding houses, especially expensive houses with wide lawns and thick, well-insulated walls, 00:32:15.000 |
Here are arrest-proofing procedures for staying free after arguments with women. 00:32:21.000 |
1. When an argument gets loud, assume that the police have been called and are on the way. 00:32:29.000 |
2. Shut up. Do not utter any sound whatsoever. 00:32:35.000 |
3. Turn on your heel. Walk to the door and leave. 00:32:41.000 |
Do not be present when police arrive, because in an angry state you'll argue, confess, flee, lie, 00:32:48.000 |
and otherwise give cops reasons not only to arrest you, but also to pile on charges. 00:32:58.000 |
In an angry state, you're likely to get into an accident or get pulled over for a traffic violation. 00:33:04.000 |
In addition, the woman may describe the car and give the license plate number to police, 00:33:08.000 |
who will then issue a BOLO, BOLO, be on the lookout notice for your vehicle. 00:33:14.000 |
Cops can find a car more quickly than they can find a person on foot who has a head start. 00:33:28.000 |
If possible, go to a restaurant, bar, or convenience store where you can sit down and cool off. 00:33:33.000 |
6. Call someone who can take you someplace to stay. 00:33:41.000 |
Do not talk with the woman. Just get in and drive, slowly and lawfully. 00:33:47.000 |
8. Do not talk with the woman for at least three days. 00:33:55.000 |
Telephone calls, answering machine messages, or notes may be considered stalking, another crime. 00:34:05.000 |
9. If you merely had a loud argument, you will likely remain free. 00:34:11.000 |
If you struck or injured the woman, you will be arrested. 00:34:15.000 |
Your attorney can find out if you have an outstanding warrant. 00:34:18.000 |
Police will take photographs of bruises and injuries, and these, and the woman's testimony, are enough to convict you in most states. 00:34:27.000 |
By leaving, you at least avoid confessing to police or committing add-on offenses, 00:34:32.000 |
so the charges will be less serious and less well-documented. This will help your defense. 00:34:38.000 |
10. Once you leave a woman after an argument, think seriously about your situation. 00:34:44.000 |
If you and the woman argue frequently and have to live in an apartment, you almost certainly will be arrested at some point. 00:34:52.000 |
If you cannot live with the woman quietly, you must leave and stay gone. 00:34:57.000 |
11. Abandon possessions rather than risk an argument that will lead to jail. 00:35:02.000 |
This is important. I'll repeat it. Abandon all possessions. 00:35:07.000 |
Your crappy stereo, dirty clothes, scratchy CDs, and cheapo fishing rods are not worth an encounter that can lead to prison. 00:35:14.000 |
Don't get steamed that your soon-to-be ex has your stuff. Think of it this way. 00:35:18.000 |
She is now the proud possessor of a crappy stereo, scratchy CDs, dirty clothes, fishing rods smeared with worm goo, and rotting shrimp and squid. 00:35:26.000 |
Say to yourself, but not to her, "Congratulations, honey. Enjoy it while you can. I'm off to Walmart to refit with all new stuff." 00:35:33.000 |
If your ex insists on holding on to your tidy whities with the tire tracks in the middle, more power to her. 00:35:39.000 |
She can frame them and hang them on the wall. 00:35:44.000 |
Communicate about child custody, real estate, and bank accounts through attorneys. 00:35:53.000 |
Avoid going to hearings if your presence is not legally required. 00:36:00.000 |
Most important, do not be in the woman's presence without a witness. 00:36:06.000 |
Do not send emails or letters that contain threats or that might become evidence against you in criminal and civil proceedings. 00:36:13.000 |
You must consider these possibilities when you are subject to arrest for domestic disturbance and battery. 00:36:19.000 |
The woman might lie and induce others to lie. 00:36:22.000 |
The woman may injure herself before police arrive so as to increase the charge against you from misdemeanor disturbance to felony battery. 00:36:43.000 |
Women can recruit the power of the state to take their side in disputes with men, with disastrous consequences. 00:36:51.000 |
I myself can testify to the soundness of this advice. 00:36:55.000 |
One of my ex-wives chased me around the kitchen, knife in hand, shouting. 00:37:04.000 |
Had the police been called, had she been the least bit injured, without question I would have gone to jail. 00:37:11.000 |
Luckily, I was teaching about domestic violence at the police academy when this happened. 00:37:19.000 |
I walked out the door, filed for divorce, and have not laid eyes on her since. 00:37:23.000 |
I abandoned thousands of dollars in new appliances at a time when my wallet was flat as a flounder. 00:37:29.000 |
Fortunately, I remained free and saved my legal career, which a felony conviction would have ruined. 00:37:36.000 |
If you haven't read Arrest, Proof Yourself by Dale Carson, I would strongly encourage you to do it. 00:37:44.000 |
It's a wonderful book and will open your eyes to the dangers that you face, but very importantly, it'll just simply open your eyes to the things that you can do to protect yourself. 00:37:54.000 |
It's always hard to read a book like that because you become extra sensitive. 00:37:59.000 |
You think it seems pretty common that people yell at each other. 00:38:12.000 |
Well, you know what to do in terms of the legal risk. 00:38:17.000 |
So, that's the advice, and I don't know of any better advice. 00:38:24.000 |
I don't think people should yell at each other. 00:38:31.000 |
But yet we live in a world in which the justice is not there. 00:38:36.000 |
So, I think that that advice is the best advice. 00:38:39.000 |
I have a hard time going to the sense that you should divorce if you had a yelling match, but I see the danger, right? 00:38:49.000 |
I do think that even as you see in the Johnny Depp case, number one, at all times assume that you're being recorded at all times. 00:38:57.000 |
And learn and practice techniques of not being angry or at least not expressing anger in any kind of verbally loud or violent way. 00:39:09.000 |
I do think that that's something that all people can learn. 00:39:12.000 |
That yelling, there's never any point in yelling. 00:39:21.000 |
But if I ever catch myself yelling, then I want to notice it and make sure it doesn't happen. 00:39:30.000 |
It's been something I've been blessed to be pretty decent at as far as not yelling. 00:39:34.000 |
I'm trying to think of any example where I have. 00:39:38.000 |
And discipline yourself and train yourself to communicate even about difficult things quietly, etc. 00:39:47.000 |
Discipline them and train them to discipline themselves in their speech so they express themselves in productive ways, not in non-productive ways. 00:39:55.000 |
Assume that you're being recorded at all times and learn to record yourself. 00:40:00.000 |
Again, I have buttons on my watch and phone and such that I use for recording notes when they occur to me. 00:40:09.000 |
I always want to have quick access to a voice recorder. 00:40:11.000 |
But if you ever wind up in a situation, use that. 00:40:16.000 |
Simply record yourself and record the encounter so that you have evidence. 00:40:25.000 |
And even if you're not in a court situation, you don't wind up in a legal battle or in a court situation, 00:40:32.000 |
it will at least protect you and help you to avoid that situation. 00:40:36.000 |
There are other things that could be said, right? 00:40:47.000 |
Understand that things don't generally improve. 00:40:50.000 |
Meaning you look at a situation that you see in brutal honesty in a court scenario with Johnny Depp and Amber Heard, 00:40:58.000 |
and you're like, "How did this ever get to this point? 00:41:05.000 |
When you're in the moment, life is never nearly as clear as it looks from an outside perspective or from a later perspective. 00:41:13.000 |
So I don't have much more that's useful to share with you. 00:41:18.000 |
And I think you need to be cautious and wise and circumspect. 00:41:24.000 |
One of the things that I wrote in the notes of my book when I was reading that, 00:41:30.000 |
I was thinking about the great debate over the so-called Billy Graham rule. 00:41:35.000 |
The Christian evangelist Billy Graham years ago had a "rule" that he lived by, 00:41:41.000 |
and that he asked all the members of his staff on his ministry team to abide by, 00:41:46.000 |
which was simply, "Don't be alone in a private place with a member of the opposite sex." 00:41:53.000 |
And that rule then has actually become very controversial over the years. 00:41:59.000 |
And Mike Pence, I think, famously ascribes to that. 00:42:04.000 |
And this was a big argument when Mike Pence was vice president of the United States, 00:42:11.000 |
that all of the feminists and the women pundits were saying, 00:42:15.000 |
"Well, women are excluded from advancements and those intimate conversations and ability to get it forward." 00:42:24.000 |
It's certainly understandable when you try to bring men and women together 00:42:28.000 |
and figure out how to have these intimate goings-on, etc. 00:42:35.000 |
meaning that the only person's behavior that you can control is your own. 00:42:42.000 |
and the only person's reputation that you have the duty to protect is your own. 00:42:52.000 |
And so you have a duty to look out for your own interests. 00:42:58.000 |
I don't work in a company where I have a bunch of other people. 00:43:02.000 |
I kind of run my own ship, so it's not a big deal for me. 00:43:05.000 |
But I think that you need to be very on your guard to make sure that, like we said, 00:43:13.000 |
not only do you not ever do anything that could be misconstrued as being wrong-- 00:43:19.000 |
don't abuse people, don't assault people, don't be a lecherous person, 00:43:28.000 |
but you need to be very, very careful to eliminate any kind of evidence 00:43:33.000 |
that could be lied about, misconstrued in any way as being wrong. 00:43:38.000 |
And I hope that this gives you some ideas about what to do. 00:43:42.000 |
I hate talking about this stuff because it makes you super paranoid, 00:43:46.000 |
but I think that paranoia in this sense is a proper perspective 00:43:51.000 |
to recognize that the dangers are significant, 00:43:57.000 |
let me talk for just a moment about marriage and divorce. 00:44:06.000 |
I think marriage is one of the most important institutions of mankind. 00:44:10.000 |
It brings a stability to society, it brings a stability to people's lives. 00:44:19.000 |
it leads to a very unstable society, which is where we are right now. 00:44:23.000 |
You've got men and women trying to figure out how to have sex with each other 00:44:32.000 |
"Well, if there's consent, how do you prove consent? How do you know consent?" 00:44:38.000 |
And so this is why marriage was developed as the bounds for sex, 00:44:43.000 |
and why it has proved so spectacularly successful 00:44:50.000 |
If you go back throughout history, you can find all kinds of societies 00:44:56.000 |
But the stable, long-running societies are where there's marriage 00:45:00.000 |
to establish clear boundaries among sexual relationships of men and women, 00:45:04.000 |
and those things were supported by the society and the legal structure. 00:45:11.000 |
where that bond, that cultural grip of the primacy of marriage has disappeared, 00:45:18.000 |
then of course we wind up seeing increasing levels of instability in society. 00:45:24.000 |
Not at all levels, not broadly, many people have perfectly fine relationships, 00:45:28.000 |
but the edges, the periphery, you can see that instability. 00:45:31.000 |
And you can see the deleterious effects of that. 00:45:35.000 |
So, as you try to figure out how to navigate through it, you say, "Okay, what do I do?" 00:45:39.000 |
And I think the reason why I wanted to mention this is that 00:45:43.000 |
in financial affairs, marriage and divorce becomes often a weapon 00:45:53.000 |
And so, this varies from state to state, country to country, 00:45:57.000 |
but if you have a marriage where love has gone cold, 00:46:02.000 |
you have partners who are considering divorce, 00:46:05.000 |
or considering how they're not happy in the marriage anymore, 00:46:14.000 |
It can move towards basically dissolving a business partnership. 00:46:19.000 |
When you're dissolving a business partnership, 00:46:21.000 |
feelings and people often go to the back and money comes to the forefront. 00:46:26.000 |
And so, one of the most common disasters that occurs to people's finances is divorce. 00:46:33.000 |
And you wind up, at the very least, having everything, 00:46:38.000 |
If you and your wife have all your assets together, 00:46:43.000 |
each of you view that money as, "We've got a million dollars. 00:46:45.000 |
Now, all of a sudden, we've got half a million dollars," 00:46:50.000 |
Then it becomes a matter of jockeying for position in court. 00:46:58.000 |
And you have to recognize that people are smart. 00:47:02.000 |
And I've worked with too many people whose spouses turn against them. 00:47:06.000 |
They start manipulating the situations, manipulating the evidence, 00:47:11.000 |
systematically compiling evidence against their spouse. 00:47:15.000 |
Because if you can take evidence into court of abuse, violent temperament, 00:47:20.000 |
if you can take evidence into court of misbehavior of some kind, 00:47:24.000 |
now you wind up getting a bigger share of the pie, potentially. 00:47:29.000 |
So, it's a big, big deal to learn how to, number one, 00:47:36.000 |
Number two, to be very careful that even with your proper conduct, 00:47:42.000 |
no evidence is created that could give any hint of that. 00:47:53.000 |
I hope that you find that, even though it's no fun, 00:47:56.000 |
I hope that you find that practical advice useful. 00:47:58.000 |
And I hope that you'll take it and help others and teach others. 00:48:02.000 |
I think that all young men and women should be taught very explicitly, 00:48:07.000 |
very carefully what I've said in this chapter. 00:48:13.000 |
And I hope that you can take these ideas and share them. 00:48:20.000 |
